GENERAL

Commission applications are handpicked, NOT first come first serve Penelope Plaid reserves the right not to sell to anyone, for any reason. Disclosed or otherwise.

PAYMENTS

50% of the payment is required upfront before beginning the project. This fee is nonrefundable, and is intended to pay for the work completed should you decide not to continue with your commission. Once the project is complete, the other 50% of the payment will be required before sending the completed files to the client. For budget and surprise me style commissions, 100% of payment is expected upfront.

REVISIONS

Five major revisions per project, additional revisions may incur additional fees. Revisions should be requested after relevant progress updates. For revisions not requested after progress updates, revisions must be requested within first two weeks after delivery. Any revisions beyond that time period may incur additional fees, or be denied. Surprise me style commissions do not include revisions.

DEADLINES AND DELIVERY

Project will be completed during agreed upon timeline. However, project length may be extended should it be agreed upon between the client and Penelope Plaid. Project deadline may be extended should client not respond to necessary communication attempts in a timely manner. Project delivery includes Vtubestudio or other Vtuber tracking software runtime files. Delivery will not include .CMO3 file. Penelope Plaid currently does not offer an express or rush delivery option. Thank you for understanding.

USE

By purchasing through Penelope Plaid, you have the right to use your commission for commercial endeavors, limited to: Self promotion, Virtual character based streaming and content creation, and music videos. However, adequate credit MUST be provided. If you have any questions, or are not sure about a particular usage, please message via Vgen, or @PenelopePlaid on twitter You may use separated parts of your model to create thumbnails for videos, memes, or other shared content. However, it must be very clear that it is NOT an original work (For example: Separating your characters hair to put on a video game character for a Youtube thumbnail.) You may not use parts of your model to create your own art that is then claimed as your own original work. (For example: An illustration of your character where you separated your models face, and then applied it to the illustration, which is then claimed as a new original work.) Credit is to be clearly written (Twitter bio, Twitch/Youtube or other streaming platform about section. For other platforms please ask how to appropriately provide credit) Commissions worked on by Penelope Plaid may not be used for AI generator training, AI image generation, used to promote/advertise for AI, or any other uses related to AI.

INTELLECTUAL PROPERTY RIGHTS

You may not resell any work created by Penelope Plaid. If you are caught having resold your files, you forfeit all rights to the work, and will be charged 200% of the final commission cost. Merchandising rights are not included, if you intend to use the rigged model, and/or model in rigged poses or expressions on merchandise or sold products (physical merchandise such as: key-chains, standees, clothing, and other physical products, or digital merchandise such as: album art, commercial video games, and other digital merchandise) then please message @PenelopePlaid on twitter, or Email [email protected] Penelope Plaid retains the rights to utilize any commissions sold without an agreed upon NDA as promotional material. (Including but not limited to: Use in promotional video for advertising/branding, images for advertisements/branding, examples in portfolio, and social media posts)

REFUNDS

Commissions are ONLY refundable in the situation that Penelope Plaid is unable to provide the completed project. Partial refunds may be considered should project exceed the agreed upon deadline.

COMMUNICATION

Penelope Plaid will provide client progress updates at least once a week via Vgen messaging. If client does not respond in a timely manner, Penelope Plaid may reach out via Discord or other preferred messaging platform to let client know that there is a progress report in their Vgen inbox, or to let client know that more information or input is required to continue the project. Project deadline may be extended should client not respond to necessary communication attempts in a timely manner.

Surprise me style commissions do not include communication of any kind during the commission process. However, Penelope Plaid may reach out to the client before beginning the commission to confirm information. The client may not reach out to Penelope Plaid regarding revisions after the commission is delivered.

Once the rigged model is complete, the rest of the payment will be required before sending the completed model to the client.
